DISCLAIMER!!!!!!

Okay. I've had a lot of people saying that I'm an 'art thief' and that me posting pictures I found is copyright infringement. So...I've decided to make a disclaimer so that they will (maybe) leave me alone. For those of you who don't know a disclaimer is a denial or disavowal of legal claim.

 

DISCLAIMER: Any pictures that I post in the Photos section of Tokyopop do NOT belong to me(unless otherwise stated), but to other artists. I am not attempting to steal their art in any way whatsoever, I am simply posting about what I love and showing my admiration for their artwork. If you are the original artist of any of the pictures and do not wish for your art to be posted please either message me or leave a comment and I will immediately remove it.

 

This disclaimer isn't for the people who keep telling me to take down my photo section, but for the artist who created the pictures. Quite frankly, I don't care what the 'art police' say but I don't want the original artist to be led to believe that I would want to try and steal the credit for their art. I'm just putting this disclaimer up to show that I post these pictures as a tribute to my love of art and anime, and that I had no intention to take credit for other people's work.

Please remove the artwork in your "Photos" and/or "Art" sections that doesn't belong to you.

It's against Tokyo Pop's ToS to submit ANYTHING that isn't your's.

Even with a disclaimer. It's still not allowed.

It's true, a disclaimer will not help. By posting work that is not yours, you are breaking the ToS.

Whoever told you to put those pictures in the photos section was wrong, and apparently, lazy. It says right above the Add Entry button (on the Add Photos Entry screen) that the Photos section is for photos from a camera or film that you've taken yourself or have legal permission to use. That means no screenshots, no DVD covers, no artwork, no Googled images, and no quiz images. Is that rule REALLY that hard to understand? No.

By the way, a disclaimer like yours will not help. Look at it this way: if you hand in an essay for a class assignment and don't provide proper credit to your sources, what happens? You're guilty of plagiarism. Why? By submitting the work without proper credit, you're automatically claiming it's yours, even if you say "these ideas aren't mine, and I never claimed they were!" The same thing applies here. By submitting works that aren't yours, even when you put up a disclaimer, you're automatically claiming they works are yours when you submit them to YOUR gallery. Unless you have permission to use a work and can include proper proof and credit, you should not post it for ANY reason.

If you can't ask the original artist for permission to use a work, then DON'T post it. If you can't provide proper credit for a work (artist's e-mail, artist's site, proof of permission, etc.), then DON'T post it. If it's something you really like, then put up links to the original artist's/company's site in a blog entry or on your profile. That way, the artist/company gets recognition, and you're not infringing on copyrights.

If you don't like this comment, feel free to delete it. There'll be others like it.

I'm sorry, but I'm afraid it is still against the ToS...the rules. ^^ I think it's best if you just take them down, but that's my own opinion. I'm glad you WOULD remove it against the artist's request... But it's still considered theft if you don't give credit, nor have permission. Also, you aren't suposed to upload copyrighted things without permission, unless it is your's. ^_^ The ToS and the warnings state this rather clearly.
